The Texas Rideshare Law
The new Texas rideshare law went into effect in 2017, and lays out statewide regulations covering Transportation Network Companies (TNCs), including regulating insurance coverage. Both the TNC driver and the TNC are responsible for insurance coverage in the event of an accident.
The Driver’s Insurance Requirements
An Uber or Lyft driver must maintain proof of registration and minimum auto insurance for every vehicle used in their rideshare gig, as required by Texas law. Their insurance covers them when the rideshare app is not on. If the rideshare app is on, the TNC insurance kicks in.
The TNC’s Insurance Requirements
Anytime the driver’s rideshare app is on, the TNC insurance coverage is in place, even if no one except the driver is in the car. Their auto insurance covers when drivers are between rides, and includes:
- $50,000 for bodily injury or death for each person involved in an accident
- $100,000 for bodily injury or death of a person per incident
- $25,000 for damage to or destruction of the property of others per incident
The TNC auto insurance coverage for each of their drivers when they are actively engaged in a ride includes a total combined limit of $1 million for death, bodily injury, and property damage for each incident.
