    Wrongful Death

    In Texas the definition of wrongful death is, “wrongful act, neglect, carelessness, unskillfulness, or default” of one person causes the death of another according to Texas statutes section 71.001. The children spouse or parent of the decedent can file a claim separately or as a group. However, if they neglect file within three months, a personal representative or executor of the estate may file a claim instead. That is unless a surviving family member stipulates that a claim not be filed.

    Johns Hopkins patient safety experts analyzed medical death rate data over an eight-year period. They calculated that more than 250,000 fatalities per year can be attributed to medical error.  Additionally, the Center for Disease Control reported there were 19,656 slip-and-fall fatalities in 2005. Factors in these deaths include slippery walkways, obstructed walking paths, poorly lit walking areas, stairways without railing, lack of safety signs, and use of unapproved ladders and other equipment.
