How do I know if I have a valid car accident claim?
The only way to know for sure is to speak to a lawyer. However, an important rule is: do not blame yourself and don’t accept blame for an accident you didn’t cause. Often, the insurance company, the other driver or both will accuse you of wrongdoing even if you are not the one who caused the accident. Do not apologize, even just to be polite or out of sympathy. And do not talk down your injuries or say you feel “fine.” Chances are good that these words will be used against you.
The question of “fault” is a very serious one in Dallas car accident cases. Under Texas law, the driver who causes an accident has to pay for the damages, including medical bills. Usually their insurance company will pay it for them—but insurers want to pay as little as possible. If they can make a case that you were even partly at fault for the accident, they can pay you much less than you deserve. This leads some insurance companies to attempt to blame the victim, even if you did nothing to cause the accident.
The best thing you can do is to get a professional legal opinion as soon as possible after the accident. Do not sign anything from the insurance company and do not agree to give them any recorded statement until you have legal advice. Your claim may be much stronger than you think—many Dallas car accident claims are worth $100,000 or more.
What if a car hit me when I was on foot or riding my bicycle?
You have the same rights as you would in any other car accident. If the driver of the car is the one at fault, they will have to pay for your medical expenses, lost work time, the cost of your bicycle, and more. They may owe you a much larger amount if they caused serious injuries or a lifelong disability. We often see this money keep a family financially stable during a very difficult time.
Some of the reasons the driver may be at fault include:
- Distracted driving
- Speeding
- Breaking any traffic law
- Ignoring crosswalks or bicycle lanes
- DUI
- Swerving
The driver may be at fault even if you did not cross at a crosswalk, or even if you were jaywalking or walking in the street.
If you have suffered any kind of vehicle accident that wasn’t your fault, don’t wait. Let us help you get the money you legally deserve. We will give you a FREE case evaluation to help you understand your rights. Simply fill out the form at the right and get your free evaluation today.
