Driving on the Right Side Laws in McKinney

Texas Transportation Code section 545.051 states that anyone operating a motor vehicle on the roadway should drive on the right half unless:

    • The driver is passing another vehicle
    • An obstruction requires the vehicle to move to the left of center (while yielding the right-of-way to a vehicle moving in the right direction on an unobstructed part of the road or that is an immediate hazard
    • The driver is on a road with three marked lanes of traffic or
    • The driver is on a road with one-way traffic

Texas law also dictates that a driver on the road who is traveling slower than the normal speed of other drivers at that time and place should drive in the right-hand lane or as close to the right curb or edge of the road as possible. The only exceptions to this rule are if the driver is:

    • Passing another vehicle or
    • Preparing to turn left at an intersection or onto a private road or driveway

In addition, anyone operating a motor vehicle on a two-way road with four or more lanes for vehicles should not drive left of the road’s center line unless:

    • An official traffic-control device has authorized a certain lane to the left of the center line for that use
    • An obstruction makes it necessary to move past the line while yielding to vehicles moving in the proper direction or that are an immediate hazard or
    • The driver must cross the center line to make a left turn into or out of a private road, alley, or driveway

Unless the driver met the specific exceptions allowed under Texas law for driving on the wrong side of the road, traveling on the wrong side of a roadway in McKinney is very negligent behavior. If your accident resulted from a driver using the wrong side of the road, you are likely entitled to damages.

Damages from a McKinney Wrong-Way Accident

To seek compensation after a wrong-way accident in McKinney, you will need to know the full extent of your damages. An experienced attorney will know how to calculate these damages. They will look at all of the ways in which the accident has affected you, including the following costs.

    Medical Costs

Medical expenses typically make up the largest portion of a car accident claim. Wrong-way accidents are especially serious, and they can leave a victim with life-threatening injuries. Under Texas law, if you were not more than 50% for your accident, you have the right to pursue recovery for medical costs like:

    • Doctor bills
    • Hospital bills
    • Prescription medications
    • Surgeries
    • Physical therapy and
    • Ongoing and future medical treatment

    Lost Wages

If you were working before the accident, you will likely need to miss work to recover from the accident. You can claim these lost wages in your case, including any earning capacity that you might lose due to your injuries.

    Property Damage

When a vehicle accident involves only property damage (and no injuries), the victim can file a property damage claim. However, if an accident involves both physical injuries and property damage, the victim can include property damage in their personal injury claim.

Property damage can include any costs of repairing or replacing your vehicle because of the wrong-way accident. It may also include other personal property that was damaged in the accident.

Just like the statute of limitations for any personal injury case, a claim that involves property damage must be filed within two years of the incident (Texas Civil Practice and Remedies Code section 16.003).

    Pain and Suffering Damages

Medical expenses, lost wages, and property damages are all economic damages that have a pretty straightforward dollar amount for compensation. On the other side of injury damages, there are non-economic losses. These damages are subjective and meant to account for damages like:

    • Physical or mental pain and suffering
    • Mental trauma or anguish or
    • Loss of enjoyment of life

In McKinney, there is no limit on how much a jury can award for non-economic damages.

    Exemplary Damages

Unlike the other damages mentioned above, exemplary damages are meant to act as a penalty or punishment for the wrongdoer. These damages are only available if the at-fault driver clearly acted with disregard for human safety or malice, such as in some drunk driving cases.

    Wrongful Death Damages

If you lost a loved one in a wrong-way accident in McKinney, you may be eligible to file a wrongful death claim to seek compensation for damages like medical costs, pain and suffering, and funeral and burial costs.

Wrong-Way Accidents Are Often Very Serious

Since accidents caused by a driver going the wrong way on a road in McKinney are often head-on collisions, they can be incredibly serious. Many wrong-way accidents result in death or leave the victim with damages that stay with them for life. That’s why our lawyers are so dedicated to helping victims and their families recover what they deserve after a wrong-way accident.

In any car accident case, it’s necessary to show that the at-fault driver was negligent in the accident. Driving on the wrong side of the road is a violation of Texas law, which clearly helps show that the driver was negligent.
