Irving Texting While Driving Accident Lawyer
The National Highway Traffic Safety Administration cites texting while driving as the single most destructive form of distracted driving. By removing one’s eyes from the road and focusing on the content of a text message, drivers are exponentially more likely to cause a severe car accident with serious injuries.
If you are involved in a texting and driving car crash, the best choice is to contact the Irving-based texting and driving accident attorneys at Pintas & Mullins, a Dallas Car Accident law firm. They can help clients recover significant compensation for injuries like:
- Broken bones

By getting in touch with our experienced lawyers, you may be able to start putting your life back in order after this traumatic accident.
Texting While Driving is Illegal
With the relatively recent passage of House Bill 62, texting while driving is banned throughout Texas. A person who’s texting and driving results in a serious injury may receive hefty punishments under the law, including:
- A fine of up to $4,000
- Up to one year in jail
Essentially, the new law puts texting and driving in a similar category as drunk driving. This means that injured people may be entitled to extra damages, known as “exemplary damages,” in some rare cases.
Important Limits on Exemplary Damages
Injured clients should be aware that exemplary damages are only awarded in the most extreme cases. Most texting and driving accidents will not result in such extra compensation. However, if they do result in exemplary damages, such compensation will be limited to the higher of two caps:
- Twice the amount of economic damages plus the value of non-economic damages up to $750,000; or
- Twice the amount of economic damages plus $200,000
Understanding Compensatory Damages
Most texting and driving accidents will include only two categories of damages: economic and non-economic. The former includes all of the harms that have clear monetary values, such as lost wages and medical bills resulting from the injury. The latter includes more subjective harms with no obvious monetary value, such as physical pain, mental anguish, and loss of enjoyment in life.
While these kinds of damages, known collectively as compensatory damages, are not capped in Texas, it may be necessary to bring expert witnesses into the case to testify for appropriate values. This is especially true with non-economic damages. Our Irving texting and driving accident lawyers can work to provide clients with acceptable compensation for all of these issues.
Compensatory Damages and Fault
In all personal injury claims in Irving, one of the most important factors to consider is fault, or responsibility for the accident. Unlike some states, Texas does not bar an injured person from receiving compensation just because they are partially responsible for the accident. In other words, a person in a texting and driving accident may be able to recover compensation from the at-fault driver even if they share a portion of the blame for the crash.
As long as the injured person is not more than 50% responsible for the wreck, they can pursue recovery in court. However, the amount of fault they are assigned does affect their potential recovery. The total compensation they can receive will be reduced by the same percentage as their percentage of fault. Here is an example:
- An injured person is found to be 20% responsible for an accident
- The injured person experienced a total of $100,000 of damages in the accident
- Their potential recovery can be $80,000, or their total damages minus 20%
