    Texting While Driving is Illegal

    With the relatively recent passage of House Bill 62, texting while driving is banned throughout Texas. A person who’s texting and driving results in a serious injury may receive hefty punishments under the law, including:

    • A fine of up to $4,000
    • Up to one year in jail

    Essentially, the new law puts texting and driving in a similar category as drunk driving. This means that injured people may be entitled to extra damages, known as “exemplary damages,” in some rare cases.

    Important Limits on Exemplary Damages

    Injured clients should be aware that exemplary damages are only awarded in the most extreme cases. Most texting and driving accidents will not result in such extra compensation. However, if they do result in exemplary damages, such compensation will be limited to the higher of two caps:

    • Twice the amount of economic damages plus the value of non-economic damages up to $750,000; or
    • Twice the amount of economic damages plus $200,000
