For bicyclists, the biggest concern they have on the road is being struck and injured by a motorist. Whether an accident is the fault or negligence of the driver of the automobile, the bicyclist, or the local government whose job it was to maintain the condition of the road where the accident occurred, someone will be found at fault.
If the negligent party is the driver, the cyclist or their family has a legal right to be compensated for his or her injuries or even wrongful death. Even with no criminal charges in this case, this driver is most probably will not be let completely off the hook. There could very possibly be a civil suit filed on the part of the family suing for wrongful death of their loved one. By law, even if there is no charge of negligence or the driver is deemed to be not at fault in an accident involving a cyclist, that cyclist or surviving family can bring suit.
