Two People Killed in Single Car Collision

Car Crash PoleEarly this morning, four people’s lives changed drastically when a vehicle ran off Dallas’ Highway 75 Central Expressway, crashing through an iron fence and hitting a utility pole. The car eventually burst into flames, killing two victims and injuring two more.

In this particular collision, only one car was involved. Just before the flames became uncontrollable, nearby residents were able to pull the two injured individuals from the car. While these victims were rushed to area hospitals—where one is listed in critical condition, and the other in serious condition—the deceased individuals were burned so badly that they were reported unidentifiable.

In accidents like these, those who are injured, as well as the loved ones of those who were killed, may be able to collect damages.

Here are different types of damages you might be entitled to claim:

    Compensatory Damages

“Compensatory damages” are monetary payments that only cover the injuries sustained by victims of the collision. The amount you are able to collect depends on the facts of your case, and could include any of the following:

    • Compensation for past and future pain and suffering as a result of the accident
    • Past and future loss of wages or lost earning capacity
    • Disability or physical impairment
    • Disfigurement and scarring
    • Emotional trauma
    • Inconvenience
    • Lost ability to participate in recreational activities
    • Past and future loss of the capacity for the enjoyment of life
    • Past and future medical and other related health care bills
    • Past and future loss of the companionship, services, comfort, society and attentions suffered by your spouse as a result of the injuries you sustained

    Punitive or Exemplary Damages

Punitive damages, or “exemplary damages,” are those monetary payments that cover above and beyond the amount required to cover the injuries. These damages are awarded when a victim experienced injury as a result of violence, oppression, malice, fraud or appalling behavior. Punitive damages are often thought of as a way to “punish” the accused for his/her wrongdoing.

    Wrongful Death Damages

For those who lost their lives in the accident, their loved ones may be able to sue for “wrongful death damages.” Differing from state to state, these damages allow you to sue for the various costs that could be associated with losing a loved one—whether it be loss of the family’s primary income, funeral costs, medical expenses, emotional damages and more. In cases like these, there is also potential for the collection of punitive damages.
