City of Ft. Worth Accidentally Demolishes Wrong Home

On July 12, contractors working for the City of Fort Worth Texas mistakenly demolished the wrong property on Watercress Drive.

The city had approved the demolition of a house that had been damaged in a fire. However, there were no records to indicate that also to be demolished was a smaller home that was located in the back yard of the property slated for demolition

Juanita Anchonda, the resident of the home had not said anything publicly about the demolition of her home because she and her family thought it wouldn’t have mattered..

“I didn’t call anyone. It’s just that I thought there’s nothing you can do,” said Anchonda. “It seemed like if they did it, they must’ve had authority to do it. So what can you do, if they did it, what can you do?”

Lost in the demolition ware all of Anchonda’s personal effects, clothing, furniture including antiques and photographs along with the family memorabilia which can never be replaced.

The city of Fort Worth’s Building Standards Commission approved the demolition for the burned home in a meeting held on February 25th of this year; however, there was never any mention of the small structure behind the home in the issued demolition order. In similar cases, the Building Standards Commission will refer repeatedly to “rear structures” in any documents that are issued.

    The matter remains under investigation.

Obviously the city made a mistake. It is more than likely this issue. More than likely it will need to be sorted out in the courts. When dealing with city and municipal governments as to who is liable for such a mistake or breakdown in communication between the city and its hired contractors may take many months and a lot of paperwork to unravel. Often with the time limitations that cities place on filing a case, having a legal professional on your side who is experienced in Texas law is essential.
